What is the Chamber of Estonian Bankruptcy Trustees?


The Chamber of Estonian Bankruptcy Trustees is a voluntary association of trustees in bankruptcy, the main object of which is protection of the professional rights and interests of trustees in bankruptcy as well as creation of the conditions necessary for ethical and professional performance of their work. 

The Chamber of Estonian Bankruptcy Trustees was founded on 14 November 1992 as a legal person in private law.

The activities of the Chamber of Estonian Bankruptcy Trustees are based on self-administration of its members. Any persons who have duly passed attestation and hold a valid certificate of a trustee in bankruptcy may become members of the Chamber, provided the Management Board of the Chamber has decided their membership after they paid the fee.

As at 31/01/2001, the Chamber of Estonian Bankruptcy Trustees had 42 members.

The main duties of the Chamber of Estonian Bankruptcy Trustees are:

  • arranging training in trusteeship 

  • amassing, analysing and generalising of practical experience in bankruptcy proceedings 

  • participation in law-drafting concerning the institution of bankruptcy 

  • using any means permitted by law in protection of the professional activities of a trustee 

  • preparation of informative, statistical and methodological materials required in the work of trustees in bankruptcy 

  • giving an expert opinion regarding problems arising in the course of bankruptcy proceedings 

  • issuing available contact information of members of the Chamber

  • promoting co-operation with trustees of scientific establishments and their associations in Estonia as well as abroad. 

The directing bodies of the Chamber of Estonian Bankruptcy Trustees are the General Meeting of the members of the Chamber and the Management Board. The General Meeting elects an audit committee to check the statutory and financial-economical activities of the Chamber.

The highest organ of the Chamber is the General Meeting of the members of the Chamber, which convenes regularly in the first quarter of each year. The Chamber is managed and represented by an at least six-member Management Board elected for a term of two years.

The present Management Board was elected on 27 March 2002 as follows:

The main duties of the Management Board are implementation of the Articles of Association of the Chamber and carrying out of the resolutions of the General Meeting of the members of the Chamber. The Management Board is convened as occasion requires, but not less than once a quarter.

The Chamber of Estonian Bankruptcy Trustees has an acting secretary, whose main tasks are organising of meetings, events and schooling, drafting of opinions and letters, gathering and arranging information regarding members of the Chamber and their activities.

The Chamber of Estonian Bankruptcy Trustees is mostly financed from membership fees of the Chamber.

The Chamber of Estonian Bankruptcy Trustees does not:
§ solve legal conflicts arising from concrete bankruptcy proceedings; 
§ preserve documents of bankrupt undertakings which are subject to archiving.
